I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to all contracts concluded between you and us as the provider Viktor Vogelsang via the website www.pumpen-peters.de. Unless otherwise agreed, the inclusion of any of your own terms and conditions is hereby objected to.
(2) A consumer within the meaning of these terms and conditions is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

§ 2 Subject of the Contract and Conclusion of the Contract

(1) The subject of the contract is the sale of goods.
(2) By placing the respective product in our online shop, we make you a binding offer to conclude a contract under the conditions specified in the item description.
(3) The contract is concluded via the online shopping cart system (Shopify) as follows:

  • The goods intended for purchase are placed in the "shopping cart".

  • By clicking the "Checkout" button, the data required for order processing as well as the payment and shipping conditions are requested.

  • Before submitting the order, all order data is displayed again in an order overview.

  • You can review your details there and correct them using Shopify's change functions or cancel the order process.

  • By clicking the "Buy now" button, you submit a legally binding acceptance of the offer, thereby concluding the contract.

(4) The order processing and transmission of all information required in connection with the conclusion of the contract takes place automatically via email. You must ensure that the email address stored with Shopify is correct and that receipt is not prevented by SPAM filters.

§ 3 Right of Retention, Retention of Title

(1) You can only exercise a right of retention if it concerns claims from the same contractual relationship.
(2) The goods remain our property until full payment of the purchase price.
(3) The following additional provisions apply to entrepreneurs:
a) We reserve title to the goods until all claims from the ongoing business relationship have been fully settled.
b) Pledging or collateral assignment before transfer of ownership is prohibited.
c) In the event of resale, the entrepreneur hereby assigns all claims from this business to us.
d) In the event of processing or mixing, we acquire co-ownership in proportion to the value of the goods.
e) We undertake to release securities if their realizable value exceeds the claim to be secured by more than 10 %.

§ 4 Warranty

(1) Statutory liability rights for defects exist.
(2) Consumers are requested to check the goods for completeness, obvious defects and transport damage upon delivery and to notify us and the carrier of any complaints as soon as possible. Failure to do so does not affect statutory claims.
(3) For entrepreneurs:

  • Only our own specifications and the product description of the manufacturer are deemed to be agreed.

  • In the event of defects, we will, at our discretion, remedy the defect or provide a replacement delivery.

  • The limitation period for defects is one year from delivery, except in legally mandatory exceptional cases (e.g., malice, injury to life/body/health, buildings, guarantees).

§ 5 Choice of Law

(1) German law applies. For consumers, this applies only insofar as the protection afforded by mandatory provisions of the state in which the consumer has their habitual residence is not withdrawn.
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply.

  2. Information on the conclusion of the contract
    The contract is concluded in accordance with § 2 of our General Terms and Conditions.

  3. Contract language, storage of contract text

    • The contract language is German.

    • The complete contract text is not stored by us. Before submitting the order, you can save the data using the browser's print function.

    • After submitting the order, you will receive an email with the order data, the legally required information and the General Terms and Conditions.

  4. Essential characteristics of the goods or services
    The essential characteristics of the goods can be found in the respective product description.

  5. Prices and payment terms

    • All prices are total prices including taxes.

    • Shipping costs are shown separately and must be borne additionally, unless free shipping is promised.

    • The available payment methods (e.g. PayPal, credit card, Klarna, Shopify Payments) are displayed on our website.

    • Unless otherwise stated, payments are due immediately.

  6. Delivery conditions

    • Delivery conditions, delivery times and, if applicable, delivery restrictions are stated in the item description or at checkout.

    • For consumers, the risk passes to you only upon delivery of the goods. For entrepreneurs, the risk passes upon delivery to the carrier.

  7. Statutory liability for defects
    The warranty regulations according to § 4 of our General Terms and Conditions apply.
